Nick Diaz’s Lawyer Not Confident About The Upcoming NAC Hearing

Nick Diaz is still hanging out and waiting to see what the potential settlement with the Nevada Athletic Commission will do for his career after he failed a drug test following his bout with Anderson Silva at UFC 183.

Diaz failed that drug test after testing positive for marijuana metabolites in January. That was his third failed drug test, which doesn’t look good on his resume to say the least.

His lawyer, Lucas Middlebrook spoke with MMAFighting recently and stated that back in May, he was very positive that a settlement with the Nevada Athletic Commission (NAC) would be reached.

Now, he’s slowly retracting those statements.

He was in the middle of arranging a settlement with Nevada deputy attorney Christopher Eccles until he got word that boxer John Molina’s settlement (over a failed drug test for diuretics) was declined by the commission.

This made Middlebrook throw the brakes on those plans. He explained why in a recent interview with MMAFighting.

“I was on the phone listening to this thinking, Well, this is a little concerning,” Middlebrook told MMAFighting.com. “You’re going to agree to a settlement with Eccles only to show up and have them say to present your case?” It made me a little cautious about going there without preparing a case as well,” Middlebrook said of the Molina situation. … “If they’re going to make you present your case anyway, you might as well take your best shot, right?”

Diaz is expected to appear in front of the commission in either late August or early September.
