Nick Diaz suspended for 12 months by Nevada State Athletic Commission
Posted on May 21, 2012, 04:50 PM by Mike DrahotaToday Nick Diaz finally appeared before the NSAC to decide his fate stemming from a failed UFC 143 drug test for marijuana metabolites. After much back-and-forth between the Nevada general attorney's office and the legal team of Diaz led by Ronald Goldman, the commission decided to take serious disciplinary action and suspend the controversial fighter for a full twelve months. On top of that, 30 percent of his fight purse was taken in addition to his fight bonus.
This may come as a shock to some, seeing as Alistair Overeem was only suspended for nine months recently due to elevated Testosterone, and Chael Sonnen received a six-month suspension after UFC 117. Perhaps the legal steps taken against the commission by Diaz to claim wrongdoing in not offering him a hearing within 45 days had something to do with this, or even his claim stating that he never lied on the pre-fight drug questionnaire may have had an effect on the outcome. It is tough to discern at this point, but the bottom line is that one of the best Welterweights on the planet is now officially on the shelf for an entire year. Diaz claimed his bout with Condit was his last fight anyway, but if he was coming back, this obviously puts a serious damper on his UFC career.
It should be noted that Diaz did have his amazing submission over Takanori Gomi changed to a no-contest after failing that fight's drug test for marijuana as well, and that he told the commission he would "never do it again" at that time. Many will soon be arguing that his punishment was too harsh, but athletic commissions frown heavily upon being lied to. What are your opinions on the outcome? Does Nick Diaz deserve such a harsh punishment or not? Are the testing priorities of the NSAC becoming blurred, with priorities in different areas, or are they spot-on? Drug testing is a huge issue in MMA right now, but it appears that the punishments handed down are always open to a huge amount of interpretation.
In any case, a great fighter will now practice his trade elsewhere, leaving MMA fans worldwide to wonder what could have been in the UFC's Welterweight division for 2012 and beyond.

you have to wonder if things would have been different if he didn't take them to court and wasn't as honest
You have to also wonder how it is that Overeem gets 9 months for illegally injecting testosterone while Diaz gets 1 yr for legally smoking weed days before his fight. I don't care if Diaz is considered a repeat offender, getting popped for roids is waaaay worse than what Nick did. I'm not the biggest Diaz fan, but I have to call total BS on this call by the NSAC.
And Diaz fights about 3 times a year or more on average. He could have gotten back to the title shot in that amount if time. Now, unless his appeal is successful, he may never get an opportunity to be UFC Champion; as stacked as the WW division is.
Nick Diaz is still a very young fighter and I would be surprised if he doesn't come back especially with the success of Nate chasing a title. He is more than ten years younger than Dan Henderson so time is on his side,.
The suspension is fair if you are not prepared to declare and challenge your medical reasons. Challenging a commission after being court red handed is not the smartest thing to do. You are better of accepting the punishment.

Nevada has no exemption for medical marijuana. So Nick had the choice of being the first to ask, with the very distinct possibility of having his license pulled for asking, or shut up and do the same thing (quit a month before the fight) he'd been doing for years.
I'm sure Nick is well aware of the bias against med marijuana by public officials.

i agree...hate the diaz brothers but they go to war...very exciting fights, always rooting against them...i guess i love to hate 'em. It was unfair, Nick needs to fire his lawyer and get chael sonnen to represent him..
To be fair to Overeem he didnt test positive for any substance they just found a T/E ratio that was outside the limit. We dont know what Reem did to get that, so its not fair to go around saying that like its fact. That aside I believe he has been on PEDs for a long time.
overeem didnt inject anyhing, his prescription drugs for his ribs contained testosterone hence why his levels were so high
If Nick decides not to fight anymore, he should piss THC loaded urine all over their front door of their main office at night. 12 hours later the stench might be some good retaliation 8))
I agree, I don't think weed is a good thing in most circumstances but I certainly am dissappointed that the commission is being more harsh for him worsening his chances at winning than Chael and Overeem who were doing it for a clear advantage.

Unfortunately, I have a view that is biased. I see families where one person's weed use hurts other family members and so I don't share everyone's view of the benign nature of the drug.
I know Lots of people use it without problems. I know some other drugs (maybe alcohol) could be considered more harmful. Its hard for me though when I see it harming relationships.
Sorry, that's my bias. Having said that. Is it performance enhancing? Rarely. I can only imagine a guy with anxiety who is a wreck in the weeks leading up to the fight. Due to his hyper nature he is not sleeping, not eating properly and having trouble focusing. This will calm him and allow him to sleep, eat properly and train properly.
I don't think thats a biased viewpoint Bruce. Thats been your experience with it so its valid for you. Its also the first conclusion that most people come to when looking at the issue as at first glance it seems to be a causal relationship between pot and personal problems.
My experience has been that people with problems tend to gravitate towards all manners of substance abuse.
Thats the basis of a lot of the research that tries to show a causal or correlation relationship.
Unfortunately it seems that as soon as the research reaches the desired conclusion ,thats the end of it. Both sides of the argument are guilty of that flaw in their research.
I tend to believe its a correlation relationship, but there needs to be more thorough studies done before I would be convinced either way.

In other words, "other family members" don't want family members smoking week--and if they do, it hurts them? If the family member was drinking beer, would the 'other family members' be hurt then?
In my experience, there are a lot of people--who are parnoid about weed smoking--they have been conditioned to feel that way. So if they encounter weed smoking--they become very upset and hurt.
I watched it so I'll go over some points for everybody (they're not really in any order I'm just going to jot them down after I remember them):
-Nick admitted to marijuana use before he it was prescribed/recommended to him by a doctor.
-Nick admitted to still getting marijuana outside of places legally allowed to sell it.
-The commission pushed hard in trying to relate Marijuana as a performance enhancing drug.
-The commission scoffed at a testimony from a doctor who related the amount of marijuana metabolites in his system to when he smoked it (siding with the fact that the amount most likely read that he smoked long before the fight). At one point a member said "but you cannot prove this", which effectively put the burden of proof on the defendant in this case and not the state (basically ass backwards from a real legal proceeding). They also heard testimony on why their testing for marijuana does not actually test for the active ingredient of marijuana (THC), they basically ignored it.
-Keith Kizer tried to imply Nick was trying to dilute (SP?) his sample after the fight was over. He used the facts that he took a while to pee and the sample was watered down. Which of course also relate to a guy who just drank a lot of water after not having it in his system from a big physical endeavor.
-Nick admitted to usage while in training camps.
-Nick admitted to the drug helping him in certain aspects of life, which inturn the commission tried to spin as being PED like,
-The commission brought up statements Nick made in the past about smoking before fights and getting it out of his system.

Wow, that was some gangster like stuff there by the nsac. It reminded me of the movie the dictator. Calling that a hearing is a complete joke. Hopefully grossman does what he does best and brings this to a real courtroom. Nick will do well in a court room with that level of honesty and openness. I hope he sues them.

I'm not against weed. I used to smoke it numerous times daily. Then I had to grow up and get a grown up job. I wish Nick was smart enough to leave that stuff alone close to fight time. He needs to make better life decisions. He is a tremendous talent and I love watching him fight. I hope he gets back on track before it's too late.
You're correct Japenegro23. He can make a lot of arguments about why weed shouldn't be banned and most people here would agree with him but in the end he is playing in the world of middle aged business men and politicians and he's not playing the game well.
If he approached this competition logically and trained to be ready he could have gone in there and done much better.

BS. Big time BS. NSAC probably used that 80's era egg in the frying pan "your brain on drugs" commercial as they're expert witness. Ive smoked some weed in my day. The only thing it helped me do was beat up a bag of Oreos. Ive gotten into way more trouble in my life drinking booze. Yet a fighter could have a few shots of JD and six pack a couple days before his fight and he there is no penalty. Why? Because it would be a freakin stupid rule if there was. Just as stupid as saying marijuana is a PED.
There not saying weed is a PED. Even though weed is not socially frowned upon in a lot of circles it is still illegal in most places, I agree with your sentiment but rules are rules, the problem here is Diaz attitude along with his team, Diaz has a medical condition like ADD or something like it, if he were smart he'd use it as a loop hole to smoke it. Just like this TRT loop hole.
They actually did try to put weed in the PED light a few times during the hearing. It was kind of sad.
Nick hasn't gone the TUE route because Kizer and a few other AC heads have scoffed at the notion of Marijuana use being allowed as on before. Especially druing Diaz's SF problems in CA. Kizer was interviewed and basically said if he applied for one in NV he wouldn't get it.. Only now, him and the rest of the commission bring it up a bunch because it paints him in a worse light.
The judges gave the figth to Condit then the Comission takes 30% of his pursue and gives him a one year suspention for smoking weed but Alistair and Sonnen get less for roids. maybe I am wrong but there is something shady here, like they want him to retire.

its beyond belief how anyone can think marijuana is a PED or how it can in anyway improve your performace in a fight. now ive never smoked the stuff but surely it would make you more prone to losing a fight? bullshit call by the nsac in my opinion
When I used to smoke it I felt no drive to get up and do anything at all and everything I did was only to make my day easier to relax. The only thing I can possibly attribute an advantage to is that I wasn't afraid to do something stupid(yet more afraid of ghosts.lol.) and pain was less severe. If I was givin a good punch in the stomach though I probably would have puked.

I don't know if it helps them relax, and therefore makes them control their nerves, breathing calmer in stressed situations, or makes them more relaxed and therefore less tense which maybe helps against certain kinds of submission holds and help their overall performance...

But if you take something that calmes your nerves before a fight, and that helps you so you don't get tense, and are loose and relaxed instead then that's a benefit.
Getting in there stiff and tense, that makes you slow, it makes you get tired wayyy quicker that if you were relaxed. Probably more prone to getting submitted as well. It may help to have smoked weed a couple of days before, maybe u don't have to be high to get some of calming effect.

Joe Rogan said it helps in BJJ. BJJ is not MMA. Plenty of other more accomplished BJJ practicioners think that mindest is utter bullshit. Plenty speak on how it makes them dumber during training or competition, and that it hurts their performance.
Trying to call it a PED relates to substances like Testosterone, different steroids, diuretics, and energy enhancers. Those are all proven to actually enhance everyone's performance while using them. Relating Marijuana to PED's is stupid. Plain and simple.
Side note: Just because Rogan and Bravo Smoke weed, and train BJJ, does not make them subject matter experts. That status is reserved for people like doctors.

Like when you are buzzed, relaxed and calm.....you take the mat with your buddy, and he catches you in a triangle while you were preoccupied with protecting from the armbar.
