NSAC responds to prior claim made by Nick Diaz

Last week news broke that the legal team of Nick Diaz had filed a lawsuit against the Nevada State Athletic Commission. Stemming from his pending suspension after a failed UFC 143 drug test, the suit relies on the basis that Diaz was denied his right to due process after not being granted a hearing within the allotted 45 days of his suspension. However, the NSAC responded to the suit with a letter from attorney general Catherine Cortez Masto. The letter states that Diaz was never in fact under the “summary suspension” his legal team listed, via mmafighting.com:

"No Notice of Summary Suspension was ever served on your client.In this matter, Mr. Diaz was properly served with a 'Notice of Hearing on Temporary Suspension' and he failed to appear at the hearing. The Commission temporarily suspended Mr. Diaz’s license at the hearing. Neither Mr. Diaz nor you objected in any manner to the temporary suspension."

The letter also went on to state that Mr. Diaz's medical marijuana card had not yet been received, only a signed authorization from a physician. The card was requested by the NSAC in early April. Diaz is well-known, by now, for having the authorization to use marijuana legally in his home state of California. It appears that there was confusion to the exact nature of the disciplinary action taken by the NSAC. Diaz' suspension is that of a temporary nature, one that will be addressed further at his scheduled hearing on the morning of May 14. The NSAC will then decide the fate of Nick Diaz, even though he has not confirmed his return to the Octagon anytime soon. As the soap opera of Diaz' failed drug test and suspension drags on, will we ever get to see Nick Diaz fight for the UFC again?

    It means nothing to you that he is my favorite pound for pound fighter. It means nothing to you that he is the only man left alive that can beat.........Fedor!

    While I am a big Fedor fan, there are several fighters who could beat him in today's MMA (Silva, Jones, JDS, Cain, Overeem, etc...), and by the same token, Fedor could beat anyone on any given night. The result when that level of talent gets in the ring is unpredictable.



    But there is one thing I do know, the man who hung his hat on beating the elite likes of Frank Shamrock, Scott Smith, KJ Noons, and Paul Daley (can you smell the sarcasm?) before entering the UFC (and beat a Penn on the downslide and lost to his first real contender in Condit), would not be a threat to Fedor. I respect Diaz, esp for his conditioning and chin, but by no means has he paid the necessary dues to be in talks with the elite MMA fighters today, in my opinion. He has dominated the Welterweight division OUTSIDE of the UFC for 3-1/2 years...during which time the UFC WW division employed the majority of the top 10 fighters at 170 (GSP, Hughes, Kos, Swick, Fitch, Condit, Alves, etc...).



    That's like me saying that I'm the best basketball player ever.......in my neighborhood. Doesn't mean thing until you get out of your comfort zone and compete against some real talent. And that will be Diaz's legacy....a man who beat up mediocre talent, but never competed successfully at the highest level of MMA competition. Or, he could be a good sport, honor his suspension, and come back to the UFC. String together some bug wins, compete for the belt, and win/lose/draw, you'd have to say he hung with the best. That, I can respect.

    Yea, beating BJ (one of the best boxers?) and going to decision on a controversial loss to Condit and was in line for a title shot means absolutely nothing lol. The hate is strong Luke! I dont think anyone except maybe one or two took the Fedor jab seriously.

    Wow! Nice response. Calm down bud, I was just poking at Bruce, and maybe my boy M1 just a little.

    But Diaz is young, and he has plenty of time to show the world just how much more he's got to cement his legacy. I think he's more than proven himself already. Everything else is just icing on the cake baby!

    And then he got paid! He's probably still getting paid! And then when he comes back, he'll be getting paid even more than before his suspension!

    And he'll still be complaining. You just gotta take the good with the bad in his case.

    Dana knows this and has even said that he treats Diaz differently because Nick doesn't give a . . . .

    So yeah, I guess he did show Dana!

    The commission should try waking up each morning without a bong packed full of buds and see how they get on when training in brazilian jujitsu.



    Thank god the Californian doctors recognise the use of medicinal marijuana to treat symptoms relating to jujitsu training.
