Dave “Pee Wee” Herman was closing in on his bout against Mike Russow at UFC 136 when he received news that he had failed his pre-fight drug test and would not be able to fight. Herman told Clinch Gear Radio that his test had come back positive for marijuana, a drug he denied using.

While Herman denied using marijuana, MMAFighting.com he did tell MMAFighting.com that he often finds himself around it. "I do not smoke marijuana. I can't say I'm not around it. I live in California. Pretty much everyone out here smokes weed. Maybe I need to pick my friends a little better. I don't know."

As far as what he can and will do about the positive drug test with UFC 136 only a week away Herman said, "I don't think there's anything I can really do. Obviously, this fight's already gone. Even if I go in today and pass everything, this fight's already done. Pretty much I guess I just wait. They said I'll probably have a short suspension. From researching other guys who have tested positive, the max suspension they've ever seen is 30 days. So I guess I wait 30 days and pass a drug test and try to get another fight lined up." – for more please see MMAFighting.com

Herman and Russow were scheduled to meet on the pay per view portion of the fight card. A featherweight scrap between Leonard Garcia and Nam Phan has replaced their fight.

UFC 136 will take place on October 8 from the Toyota Center in Houston, TX.

yeah, the tests have become very accurate depending on what method is applied, especially with the blood and hair testing. if it was one of those, he simply got busted. but on the other hand: sweat or urine tests will only show the existance of thc metabolites and nothing else.

so does anyone know what type of tests the athletic commision uses?

big deal. as long as he follows the script the UFC hands him for talking about the incident in public, we will see him back in the cage. they let roid users stick around, and weed isn't a preformance enhancing drug.

It can calm your mind though which is why its used a lot before grappling as it relaxes you. Same as beta-blockers in effect as they can be used calm you down which can be an advantage.

It depends on what weed you smoking. Often it can make you nervous and a bit paranoid, not as relaxed as you might think. Plus cutting weight's a right bummer with munchy attacks all the time.

The UFC doesn't allow it because it causes the muchies and then the fighters come in over weight.

They make too much money off it being illegal ..

Its just like the "War on terrorism" only its the "war on drugs" ... an unidentifiable enemy with no leader or country and no way to ever say you won the war ... just a money-sucking black-hole and a reason to raise taxes.

    On a side note:

It was legal in the USA and sold in Pharmacy's up until the late 20's .. when prohibition kicked in ... they brought back alcohol and demonized Marijuana. When it should have been the opposite (IMO).

THC would probably qualify as a performance un-enhancement, and it's a joke that it's illegal.

But as long as it is illegal, and you want to be a pro fighter, it's a pretty simple choice. Lots of time to get baked when you retire.

Marijuana's illegal. It doesn't matter if they decide to outlaw ice cubes, if it's illegal, it's illegal. You don't have to agree with it, you just have to comply. Pee-wee made a stupid choice, and just saying "oh well everybody around me is smoking pot" is an awful excuse. To fight in the UFC is a prestige honor, and you have to follow the law, otherwise you'll lose that opportunity.

Pee-wee really Nick Diaz'd this one.

Personally, I think it's a crime that marijuana isn't legal yet. But that has nothing to do with this. It doesn't matter what I think or what you think or what Dave Herman thinks, he failed a drug test, plain and simple. It has nothing to do with being a goodie two shoes or never breaking the rules, it's that the law is the law, and if you break the law, what you think doesn't matter anymore.

And if Pee-wee cared that much about his fighting career, he'd recognize that. The people who make the laws are the goodie two shoes. And they happened to be our bosses. So you can say "Screw the law man I'll do what I want" and seriously mess up your professional career, or you can say "the laws are what they are, and if I don't follow them, there are some serious ramifications" and obey the rules.
